The Meghalaya High Court has ordered the civil case filed by Seng Khasi Mawsynram represented by its president Tyllilang Myrthong to be taken up by the District Council Court.
Myrthong had filed a PIL before the High Court alleging that the Syiem of Hima Mawsynram had “wrongfully” taken possession of a piece of land at Mawsynram belonging to the Seng Khasi Mawsynram and preventing the organisation to perform its religious practices on the property.
From records available, the case is also pending in the District Council Court after the Syiem of Hima Mawsynram filed a title suit against Myrthong and Seng Khasi Mawsynram over the land.
The division bench of Chief Justice Indra Prasanna Mukerji and Justice Wanlura Diengdoh in an order passed today directed the respondents to produce the cause papers of the proceedings before the District Council Court together with orders that may have been passed by the District Council Court in order to enable the High Court to assess the rights of the parties prima facie and pass appropriate orders on the PIL.
“We make it clear that pendency of the PIL will not prevent the civil court from proceeding with the suit in accordance with law,” the High Court said in its order.
