Meghalaya is yet to pre-published the draft rules under the Code on Social Security, 2020.
The Code on Social Security, 2020 is a code to amend and consolidate the laws relating to social security with the goal to extend social security to all employees and workers either in the organised or unorganised or any other sectors.
However, Meghalaya, Nagaland, West Bengal and Tamil Nadu and the Union Territories (UTs) of Dadra & Nagar Haveli and Daman & Diu, Lakshadweep and NCT of Delhi have not pre-published the draft rules under the Code on Social Security, 2020.
The states which have pre-published the draft rules under the Code on Social Security, 2020 are Andhra Pradesh, Arunachal Pradesh, Assam, Bihar, Chhattisgarh, Goa, Gujarat, Haryana, Himachal Pradesh, Jharkhand, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Manipur, Mizoram, Odisha, Punjab, Rajasthan, Sikkim, Telangana, Tripura, Uttarakhand, Uttar Pradesh, and the UTs of Andaman & Nicobar Islands, Chandigarh, Jammu & Kashmir, Ladakh and Puducherry).
The Central government has formulated four Labour Codes, namely, the Code on Wages, 2019, the Industrial Relations Code, 2020, the Code on Social Security, 2020 and the Occupational Safety, Health and Working Conditions Code, 2020 and published these Codes in the Official Gazette for general information.
The four Labour Codes envisage strengthening the protection available to workers, including unorganised workers in terms of statutory minimum wage and its timely payment, social security, occupational safety, healthcare of workers, etc.
As a step towards implementation of the all four Labour Codes, rules are required to be framed by the Central government as well as by the state governments.
All the states and Union Territories have been asked to formulate their draft rules by the end of 2023. Once that is achieved, it is anticipated that the labour codes will be enforced after the Lok Sabha elections of 2024, with certain modifications.
