Shillong, Aug 8: Ahead of the GHADC Session scheduled for August 10, District Magistrate of West Garo Hills, Vibhor Aggarwal, has prohibited assembly of five or more persons for demonstrations, protests, rallies or gatherings within the Garo Hills Autonomous District Council (GHADC) office premises in Tura.
In an order issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the District Magistrate said reliable inputs indicate that a bill regarding a separate electoral roll is likely to be passed during the session, and that large public gatherings are expected around the GHADC office. The order stated that miscreants or vested interests may take advantage of such gatherings to disrupt proceedings.
The order noted that large assemblies within the GHADC premises could obstruct normal functioning of council offices and disturb public order and tranquility. There is also apprehension of confrontation, disorder and obstruction of entry and exit, which may require immediate preventive measures to ensure safety of officials, employees, visitors and members.
As per the order, no person or group shall organize, participate in, or facilitate any unlawful assembly, demonstration or procession within the GHADC office premises in a manner likely to obstruct functioning or disturb peace. No one shall also obstruct entry or exit of officials, employees, elected members and visitors.
The restrictions will not apply to officials and employees on duty, elected GHADC members acting in official capacity, police and law-enforcement personnel, emergency services, and persons with legitimate official business, subject to lawful directions.
The public, political parties, associations and NGOs have been directed to maintain peace and refrain from any act causing obstruction or disturbance. All Magistrates and police officers deployed in the area have been asked to ensure strict enforcement and take preventive action against violations.
Violators will be liable for action under Section 223 of the Bharatiya Nyaya Sanhita, 2023, and other applicable laws.
