Shillong, Aug 11: The Meghalaya High Court has directed the Executive Committee of the Khasi Hills Autonomous District Council (KHADC) to reinstate Pa’iem Ainam Manik Syiem as the full-fledged Syiem of Hima Mylliem.
The order was passed by Justice Wanlura Diengdoh while hearing a petition filed by Ainam Manik Syiem challenging his suspension by the KHADC.
The court also set aside the KHADC’s order dated May 22, which had appointed Alban Fedrick Syiem as Acting Syiem to take charge of the Hima’s affairs.
The court observed that the KHADC’s action in suspending the Syiem of Hima Mylliem was not in accordance with the provisions of the Khasi Hills Autonomous District (Appointment and Succession of Syiem, Deputy Syiem, Electors and Rangbah Shnong) Act, 2007. As such, the suspension order was declared null and void.
On the issue of the Deputy Syiem, the court said since the suspension of the Syiem itself was not in accordance with law, the petition filed by Syiem Khynnah Mansan Manik Syiem has become infructuous. He has also been reinstated as Acting Syiem.
According to a notification issued by the Secretary of the KHADC, Ainam Manik Syiem was suspended as Syiem of Hima Mylliem under the powers conferred by Section 7 of the Khasi Hills Autonomous District (Appointment and Succession of Syiem, Deputy Syiem, Electors and Rangbah Shnong) Act, 2007.
