Leader of the opposition in the KHADC, Titosstarwell Chyne, today suggested that the executive committee led by Pyniaid Sing Syiem should seek legal advice to challenge the recent High Court of Meghalaya order that allows the district courts of the state government to try cases between tribals.
Recalling that the state government has assured that the notification extending the operation of the CrPC and CPC in the state will not interfere with the functioning of district council courts, Chyne said that now the government’s district courts have started holding trials between two tribals, which would have previously been the jurisdiction of KHADC courts.
In response, the Chief Executive Member, Syiem, assured that the EC will follow up the matter and ensure that the power to the council via Paragraph 4 of the Sixth Schedule will not be eroded.
Stating that the EC will raise the matter seriously in consultation with the opposition, officials and legal experts, Deputy CEM, Pynshngain N Syiem, said, “If we lose the power of judgment, then the power to rule will also be lost as these two go hand in hand.”
