The Meghalaya High Court has directed the State government to provide specific instructions and details of the cases where Bernard Marak has been implicated and to disclose the details of pending cases against him.
The bench of Justice Hamarsan Singh Thangkhiew passed the order today on a writ petition filed by Marak’s wife L K Gracy.
‘The State respondents are directed to provide specific instructions and details of the cases where the petitioner’s husband has been implicated, and stated to be involved on the next date. It is also provided that nothing shall prevent the State respondents from disclosing the details of pending cases to the petitioner,” the High Court said in the order.
In her writ petition, Gracy stated that her husband who is presently in police custody has been subject to several criminal proceedings, and in spite of obtaining bail in five cases, is being implicated in further cases wherein his involvement is not known.
Gracy’s lawyers A M Bora assisted by B K Baidya told the High Court that the action of the State government has deprived Marak of his legal rights, as after being released in one case, has been arrested in another.
Additional Advocate General N D Chullai assisted by government lawyer R Colney requested the court to give them time to obtain specific instructions from the government on the matter. The case will be heard again on November 9.
