Chief Minister Conrad Sangma said that the notification extending the operation of CrPC and CPC in the State will not interfere with the functioning of district council courts.
“The intention of the notification is purely to regularise the separation of the executive from the judiciary,” Sangma told media persons here today after his meeting with a KHADC delegation led by Chief Executive Member Titosstarwell Chyne.
The meeting with the KHADC is to clear the confusion and misunderstanding of the CrPC and CPC.
“The message that was given to the District Council is that the entire purpose of the CrPC and CPC notification is to allow the judicial magistrate to continue the work and the functions that are being done by the judiciary of district councils,” Sangma said.
He also said that the provision and the power of the district council courts are protected by Para 4 and 5 of the Sixth Schedule of the Constitution.
“As far as the notification is concerned, no matter how many times we change things, the wording may change and anybody can try to interpret the notification in anyway but the most important protection of the district council and the court have is through the provision of Para 4 and 5 of the Sixth schedule,” Sangma said.
