A notification will be approved by the State cabinet within the next two weeks regarding extension of the Code of Criminal Procedure, 1973 in Meghalaya.
This was informed by Advocate General Amit Kumar during hearing of a criminal appeal by Komerchand Sing Wanrieh in the division bench of Meghalaya High Court today.
Kumar said that the matter pertaining to the issuance of a notification under the Proviso to sub-section (2) of Section 1 of the Code of Criminal Procedure, 1973 was taken up by the State cabinet last week.
He also said that following the apprehension expressed from some quarters, including the Autonomous District Councils, discussions have been held, and it is hoped that appropriate notification in such regard will be approved by the cabinet within the next two weeks.
Following the submission by Kumar, the High Court decided to hear the matter on August 24.
The Code of Criminal Procedure, 1973 is applicable to the whole of India except Nagaland and tribal areas as referred to in paragraph 20 of the Sixth Schedule to the Constitution, other than those within the local limits of the municipality of Shillong.
At the same time, sub-section (2) of Section 1 of the CrPC gives the State government the power to extend the operation of the Code to tribal areas by notification.
