Prevent Fatalities From Involuntary Secondhand Smoke

      Editor,

The sharp 50 per cent surge in passive smoking fatalities across India,l as recently highlighted by “The Lancet Public Health” signals a catastrophic yet preventable public health emergency. As a world-renowned medical journal specializing in public health equity and epidemiology “The Lancet Public Health” brings crucial empirical rigor to an issue that has long remained hidden behind closed doors. The publication reveals that over 444 million citizens nationally and more than 767 million children globally are regularly subjected to the hazards of environmental tobacco smoke. While overall smoking prevalence has marginally declined due to public space bans, the sheer volume of involuntary exposure highlights a severe failure in shielding vulnerable populations from secondary inhalation.

This alarming trajectory exposes a profound violation of fundamental constitutional guarantees guaranteed to every citizen of India. Under Article 21 of the Constitution of India the Supreme Court has repeatedly affirmed that the right to life extends beyond mere animal existence to include the right to live with human dignity in a clean, healthy and pollution free environment. In Deora v. Union of India (2001), the apex court explicitly recognized that a non-smoker cannot be compelled to become a passive smoker against their will, declaring that involuntary exposure to tobacco smoke directly infringes upon Article 21. When non-smoking women and developing children are subjected to high concentrations of toxic side stream smoke within domestic spaces their fundamental right to health and life is compromised without recourse.

Beyond Article 21 the persistence of passive smoking highlights a breakdown in executing the Directive Principles of State Policy. Under Article 47 of the Constitution the State is under a primary constitutional duty to raise the level of nutrition and the standard of living of its people alongside the improvement of public health. Article 47 explicitly directs the State to endeavor to bring about the prohibition of the consumption of intoxicating drinks and drugs injurious to health. By failing to enforce strict regulatory oversight over secondary smoke hazards, the State falls short of fulfilling this constitutional directive. Furthermore Article 51A(g) imposes a fundamental duty upon every citizen to protect and improve the natural environment and show compassion for living creatures. Allowing toxic indoor air to degrade the bodily integrity of cohabitants directly contradicts this civic obligation.

Medical research leaves no room for ambiguity regarding the lethal nature of side stream smoke. Inhaled non-voluntarily it contains higher concentrations of carcinogens and toxic compounds than the mainstream smoke drawn by an active smoker. Continuous exposure leads directly to coronary heart disease, stroke, lung cancer and permanent, irreversible pulmonary damage in young children. Because domestic environments remain entirely unregulated, women and children bear a disproportionate burden of chronic daily exposure, trapped in spaces where social structures often prevent them from asserting their right to clean air.

To translate these constitutional mandates into meaningful action policymakers must enact a comprehensive structural response. First existing tobacco control regulations under the Cigarettes and Other Tobacco Products Act (COTPA) must be rigorously updated and strictly enforced. Secondly statutory frameworks must evolve to support smoke free housing initiatives and commercial space guidelines that eliminate secondary exposure. Thirdly aggressive public education campaigns must be launched to highlight the invisible toxicity of indoor secondhand smoke alongside increased taxation on tobacco products to fund public cessation support.

Public health is not merely a policy preference. It is a constitutional right. Protecting non-smokers from lethal indoor pollutants is a basic statutory mandate. It is time for the executive and legislative branches to uphold the spirit of Article 21 and Article 47 by taking decisive action against passive smoking.
