Shillong, Mar 18: The Meghalaya High Court acquitted a woman who was sentenced to life imprisonment by a lower court in the murder of her husband and children in 2003.
The judgment was passed by the Additional Deputy Commissioner (Judicial), West Jaintia Hills District, in August 2021.
“The prosecution has miserably failed to prove its case i.e., the circumstances, against the appellant, by leading cogent, legal and admissible evidence and that the chain of evidence is far from complete,” a division bench of Chief Justice Revati Mohite Dere and Justice Wanlura Diengdoh today said.
The High Court said that the alleged confession of the appellant suffers from several infirmities and as such, implicit reliance cannot be placed on it.
“It may also be noted that no question was put to the appellant while recording her statement under Section 313 CrPC vis–a–vis the alleged confession made by her,” the court observed.
Earlier, during the hearing the court stated that the Additional Advocate General relied on Section 80 of the Evidence Act, 1872.
