      MLA’s rape case: Who’s the victim?

      In the last few days, we had been reading news of accusation of rape against an MLA by a lady. This is not the issue I want to discuss now. As a common man, I have full faith in our judiciary system. Proper investigation will definitely be done and justice will prevail.

      What worries a common man are the societal and family aspects of such cases. These types of cases of a man accused of rape by a woman later after years of relationship we often come across. But they adversely impact our societal structure. Our society is composed of families where husband and wife are expected to be loyal to each other and together raise their children and family in a healthy way. Healthy family system leads to a healthy society.

      Our society does not encourage extra marital relations. If a couple has a problem between them, they can separate legally and start a new life again, rather than having extra-marital relations and affecting the stability of the family and society as a whole and affecting the children most of all. All these relations leave a bad impact on the society and on the growing children.

      This recent case is one of the many cases of its type. Here as per the lady who lodged the complaint, the man first raped her. She did not go for legal help that time as he promised her then that he will divorce his wife and marry her. Trusting his promise she continued having an affair with him but as he did not divorce his wife and marry her, she came forward for legal help and now filed an FIR against him.

      Due justice will definitely be done. After investigations either the man will come out guilty or it may be a honey trapping case. Lots of assumptions can be made. Rather than making assumptions, let us look forward with full faith in our judicial system.

      In this type of case usually it is seen that all sympathy goes towards the woman. Let us analyse these incidents from an unbiased angle. First if the man had actually committed the crime he is grossly wrong and should be punished as he committed crime not only against the woman but did injustice towards his own wife, children and society as a whole.

      But the lady is also wrong too. First of all, if she was raped, she should have come forward for legal help immediately. Rather than doing this, she bargained with the man and made a deal with him that she will keep quiet and have an affair with her and he will marry her for that. She is an adult, in a sound state of mind, who fully knows the consequences of her actions. She made a deal that will ruin another lady’s life and family, in order to start her own family by marrying this man.

      How can one lady think of ruining another family to build her own? How can one even have an affair with someone who raped her? How can one voluntarily go and meet the person who keeps raping her? How can one think of getting married to a person who is already married? How can one even think of doing injustice to another woman? What future will she give to her child who is not born yet from such unstable relations? Will the child get a stable healthy environment for healthy psychological development? Is this not injustice to the child who is not born yet?

      If we see from all these angles, rather than the lady being the victim we find the actual victims are the man’s wife and children. The husband is disloyal if he has an affair with the lady and the other lady is trying to break her marriage and her family. The children themselves undergo so much mental turmoil. They are the victims. How is the complainant a victim?

      If the man has raped her he is grossly wrong, and the lady is grossly wrong in making such a deal, she is wrong in entering into the relationship with him after knowing well he is married. She may be calculating her gain, for which she is even ready to ruin another woman’s life. A marriage is based on trust, love and respect. How can she trust, love and respect the person who raped her? These calculated approaches should be investigated too. By these calculated approaches this lady is harming the dignity of every woman.

      Usually it is seen in such cases everyone gives importance in doing justice to the lady versus the man. The other aspects are often ignored. The main victim is ultimately the wife who is suffering from all angles for no fault of hers. The children are suffering immensely.

      This type of case keeps coming up now and then. In doing justice to these cases, I request our esteemed judiciary system to pass a hallmark judgement which will safeguard the respect and rights of the wife; family and also keep in mind our societal system. So that no man will commit a crime against not only another woman, but also stay within the boundary of marriage and family system, and no other woman claims herself as a victim after trying to ruin a woman’s life and ruining a family.

      The principles and ideology of our societal structure need to be held high. Please pass a hallmark judgement so that such cases do not keep coming up again and again. Everyone should hold high the ideologies of their families and society.
