In a reprieve, the Chancellor of CMJ University, Shillong and his two brothers escaped arrest as the Meghalaya High Court put on hold the bailable arrest warrant issued against them till June 10.
The arrest warrant was issued on April 26 by the Chief Judicial Magistrate, Shillong against Chandra Mohan Jha and his brothers – Govind Jha and Gopal Jha.
However, the Jha brothers moved the High Court challenging the order of the Chief Judicial Magistrate. During a hearing on June 3 in the High Court, the lawyer for the petitioners A P Singh said that the order of the Chief Judicial Magistrate was never uploaded in the Case Information System (CIS), but was uploaded only on June 2 thereby depriving the petitioners to seek for relief as far as the issuance of the bailable warrant of arrest is concerned.
Singh also told the High Court that the Chief Judicial Magistrate, Shillong is on leave and therefore, on the next date, which is June 2, no effective order was passed in the case.
Singh also requested to be allowed to file a separate application before the High Court on this matter and in the meantime, he requested that the order passed by the Chief Judicial Magistrate, Shillong on April 26 be stayed.
“On consideration of the submission made at the bar, in view of the urgency of the matter, this court hereby allows the prayer made with regard to the order dated 26.04.2022,” Justice Wanlura Diengdoh said while directing the petitioners to file the application within one week.
In the meantime, the High Court put on hold the order whereby the bailable warrant of arrest has been issued against the Jhas till the next hearing on June 10.
