Murder convicts Nidamon Chullet and Coming Rabon who have challenged against their conviction in the High Court have also sought bail from the court.
The duo questioned the very authority of the trial court to have taken up the trial against in the murder case.
They also told the High Court through their lawyers that on merits they are entitled to bail as the judgment of conviction is based on the oral evidence of accomplices, which should not have been relied upon.
Further, Chullet and Rabon stated before the High Court that since the jurisdictional issue may take considerable time while they remain detained in prison, the application for bail should be taken up de hors the jurisdictional issue and based on the reasoning furnished in support of conviction in the judgment of the trial court.
The matter was heard by the division bench of Chief Justice Sanjib Banerjee and Justice Wanlura Diengdoh today. However, the bench listed the hearing of the matter on July 21.
It may be recalled that on January 19, the District and Sessions Court, Jowai convicted Chullet under Section 302 of IPC for murdering one Ewanmi Lhuid in Jowai in February 2008.
Apart from getting life imprisonment, Chullet was also fined Rs 50,000 by the court.
Chullet was earlier the NPP working president of Jaintia Hills region. He also holds the post of president of Jaintia Hills Truck Owners’ Association (JHTOA).
Rabon was convicted under Section 201 of IPC. He was sentenced to seven years of imprisonment with a fine of Rs 10,000.
Both of them have challenged their conviction in the High Court in April this year.
